Terms & Conditions
These terms and conditions apply to any booking made to visit the Peacemakers Museum (Derry). Please read these Terms & Conditions carefully before you make any online order. Information about us: By booking a visit (making an admission purchase online) you are entering into an agreement with The Board of Trustees of the Gasyard Development Trust, Gasyard Centre, Lecky Road, Derry, N Ireland (we, us, our) on these Terms. Booking admission In booking admission with us you understand and agree that: • Admission is valid only for the specific date and entry time slot (where applicable) stated upon purchase (and the number and category of person[s] – i.e. child/concession/adult); • During your visit you must present your booking confirmation to representatives to secure access; and • [subject to these Terms], admission is non-refundable and may not be exchanged. Entry • Your visit to the Peacemakers Museum is at all times subject to any notice to visitors we post on the premises, and our standard admissions guidelines as may be amended from time to time (see below). In addition, you and any persons for whom you have purchased admission must comply with any reasonable instructions given to you by our staff or any third party instructed on our behalf during your visit. • We, acting reasonably at all times, may refuse to allow entry to our premises, or remove from our premises without any right to a refund any person that fails to comply with the Admissions Guidelines and/or any reasonable instructions that we (or our staff or third parties instructed on our behalf) may give to visitors from time to time. Amendments to admission/events/exhibitions & T’S & C’s of Sale • We reserve the right at our discretion to alter our advertised arrangements for admission, events and exhibitions, and to cancel any admission time slot or event or exhibition without notice. • Our terms and conditions of sale may be changed. Please review them regularly. If you continue to use the website after a change has been made you are deemed to have accepted it. • If this occurs and you have purchased admission, we will, where possible offer you an exchange or refund of your purchase. Online Booking • Once your online booking has been confirmed an order confirmation will be sent to the email address you specified in your order (normally immediately but certainly within 24 hours), at which point a contract will come into existence between you and us. No agreement is formed between you and us for the purchase of admission until we email you with this confirmation. • If you do not receive an email confirmation or are unable to see the confirmation screen or have any other problem, please email us at info@peacemakersmuseumderry.com. • It is your responsibility to check prior to purchase that the information you have supplied to us with regards to your admission requirements is accurate. • We do not send tickets in the post. You just need to bring your booking reference with you on your mobile or if you prefer, you can print the PDF or email confirmation and present this when you arrive at the Museum. • We accept online payment in a secure environment by credit or debit card. We currently accept Visa, Mastercard©, Delta and Maestro©. All transactions are shown in pounds sterling (£). All prices quoted are correct at the time of publication and where appropriate include UK sales tax (VAT) at the current rate. • Should cancellation of an Admission Slot / Event or Exhibition (or any part of it), be necessary we will attempt to contact you (by email to the email address provided in your order) in advance to arrange alternative admission. Please check your email inbox before travelling to the Museum to avoid an unnecessary journey should an Event or Exhibition be cancelled. • When you book admission using the website, you are deemed to have read, understood and agreed to all the terms and conditions detailed here. You agree that: • In booking admission, or presenting yourself for admission regardless of whether you were the person who booked admission, you understand and agree that: • you have no right to a refund or exchange of your admission (except as set out in our cancellation and refund policy); • your visit to the Museum, including to any exhibition or event, is at all times subject to any notice to visitors we post on our premises and to the direction, supervision and guidance of our staff, which may include directions in relation to health and safety; • your ticket is subject to our Resale policy; • we reserve the right, at our sole and absolute discretion, to refuse to allow you to enter the Museum, or to enter into any exhibition or event, and/or escort you from our premises if, in our judgment, you breach any of these terms and conditions (including if you arrive outside the date and time slot stated on the face of your ticket), and in such case, we shall have no liability to you. Types/Classes of Admission • When you book admission with us, there are different admission classes for different people. These are defined as follows: • Adult: a person aged 17+ • Child/concession: a person aged 0 to 16 years old inclusively Ticket purchase and validity • When you have confirmed your order, no details of your booking can be changed. You have no right to a refund or exchange of your ticket (except as set out in our cancellation and refund policy). Most tickets are not transferable - they are only valid for the time, day and event stated upon them. • When you arrive at the Musuem, you may need to produce identification if you have bought concession admission. If you requested admission but do not have your booking reference or relevant identification, you may be refused entry. Lost admission documentation • We will not be responsible for any admission documentation that are lost, stolen or destroyed. Replacements will be issued at our discretion. Resale policy • Admission / bookings are for personal use only and cannot be resold, transferred or used for promotional, commercial or fundraising purposes without the prior written permission from the Museum. • If a booking is resold or transferred for profit or commercial gain by anyone other than us or one of our authorised sub-agents, then admission will be void. If you attempt to enter the Museum, an exhibition or an event with a ticket that has been resold without the Museum's written consent, you may be refused entry to, or ejected from, the Museum and no compensation will be payable to you by us. Cancellation and Refund Policy [for online bookings] • As a small independent charity, we have a number of fixed costs, and cannot afford to run our operations at a loss. Therefore, the following cancellation and refund policy applies: • Full notice given (i.e. more than 14 days before the event) – full refund • Partial notice given (i.e. between 5 days and 14 days before the event) – 50% refund • Short notice given (i.e. less than 5 days before the event) – no refund • In the event that we need to cancel your booking – we will contact you to offer you a new date/event or a full refund. • Refunds are made via our online bookings system, bank transfer or cheque (depending on how the booking was made). In the event that a refund is sought, providing there is no issue and adequate notice is given – the refund should be processed within 14 days. Limitation of liability • We shall not be liable to you in any circumstance for any loss of business, revenue, profits, anticipated savings or goodwill (whether direct or indirect) or for any indirect, special or consequential loss of any kind and in each case howsoever arising, under these terms and conditions even if you have advised us of the possibility of same. • Our maximum liability to you under these terms and conditions shall not exceed the total amount you paid for admission. • The Museum shall not be deemed to be in breach of these terms and conditions or any other contract with you by reason of any delay in performing or any failure to perform any of its obligations in relation to tickets ordered by you if the delay or failure was due to any cause beyond its reasonable control. • Nothing in these terms and conditions shall serve to exclude or limit the Museum's liability in respect of death or personal injury caused by the Museum's negligence or the negligence of its officers or employees or for any fraudulent misrepresentation or any other liability that cannot, as a matter of law, be excluded or limited. • The limitations set out in this section apply equally for the benefit of the Gasyard Development Trust / Gasyard Centre. Filming • From time to time we may, or we may authorise third parties to, carry out filming, photography and/or sound recordings at [our premises and Events]. By purchasing admission you agree (on your own behalf and on behalf of any persons for whom you purchase tickets and who attend our premises/ an Event) that we and any third party authorised by us may include you and those you have bought tickets for in such films, photographs and/or sound recordings and may exploit such films, photographs and sound recordings in perpetuity in any format whatsoever without payment. • You are responsible for bringing this provision to the attention of any person for whom you have bought tickets. We will always let visitors know if filming or photography is taking place during their visit. Photography • You may be permitted to use a hand-held camera or mobile phone for private and non-commercial purposes but you and any other visitors for whom you purchased admission must comply with any restrictions on photography which we make known to you. • You may commit an offence if you copy, upload or publish any material which is protected by copyright without the consent of the relevant copyright owner. If this occurs you may face criminal or civil penalties. Visitors under 12 • Visitors under 12 years of age must be accompanied, at all times, by an adult. Access to events • We reserve the right to remove from an event or refuse entry to anyone who: • behaves in a way that adversely affects the enjoyment of other visitors • uses threatening, abusive or insulting language or behaviour, or in any way provokes a breach of the peace • is or appears to be under the influence of drugs or alcohol • uses a void ticket, as per our Resale Policy Admission Guidelines Opening times We are open: Mon-Fri: 9.30am-5pm (All year round) Sat: 10am-4pm Sun: 10am-4pm (Apr-Sept) The Museum is closed 24-26 December, 1 January, Easter Sunday. Conditions of entry • While you are at the Museum please take care of your own health and safety and our collections. In order to ensure a safe and enjoyable experience for everyone, please do not: a. touch objects on open display b. smoke in the Museum (including electronic cigarettes) c. disregard alarms, signs, barriers or directions given by staff d. leave personal property unattended e. eat and drink other than in designated areas f. bring in to the Museum any restricted item (see below) g. fundraise, demonstrate or distribute campaigning material, without prior agreement h. ride bicycles, scooters or any other wheeled item (other than a mobility support vehicle/device) Personal property • Please look after your personal property while at the Museum. Any property/luggage/ baggage left unattended may be removed from the Museum floor. If you lose any item during your visit, please speak to a member of staff. Buggies/prams may be utilised and ‘parking’ is available in a number of locations throughout the Museum. These are not staffed, and are used at the visitor’s own risk. Restricted items • Please do not bring the following on to Museum premises: a. Alcohol. Alcohol may only be consumed, if purchased on site, in a designated area b. Clothing with offensive signage or logos. c. Animals, with exception of Assistance Dogs. d. Potentially dangerous items such as fireworks or knives. Knives which are carried for religious or cultural observance (such as the Kirpan) are normally exempt from this policy e. Any clothing or item worn deliberately to obscure the face, but with the exception of items worn for health reasons, or religious / cultural observance such as a Niqab or Burkha. f. Balloons, as these can interfere with our alarm systems if they float away. Breastfeeding Our visitors are welcome to breastfeed anywhere on site. Our Staff • All our staff are identifiable from their Peacemaker Museum passes. There is a Duty Manager on site whenever we are open to the public, to ensure that you have a safe and enjoyable visit. If our staff think you may be causing unreasonable offence to other visitors, or are endangering yourself, others, our property or our collections, they will ask you to stop. Our staff have the authority to escort you from the Museum premises if necessary. • We will not tolerate abuse or violence towards any visitor, contractor or member of staff. • Closed Circuit Television is in use throughout the Museum; images are recorded for the purpose of Health & Safety / Insurance Compliance, Public Safety and Crime Prevention, in line with Data Protection legislation. Compliance with terms We have the right, without liability to you, to refuse to allow you to enter and/or to escort you from our premises if you, in our judgment, breach any of these Terms. General Website Use • Access to and use of this site is provided by the Peacemakers Museum [Gasyard Development Trust] subject to the following Terms and Conditions. • Use of this site constitutes your acceptance of these Terms and Conditions which take effect when you first use this site. Gasyard Development Trust reserves the right to change these Terms and conditions at any time by posting changes online. You are responsible for reviewing regularly information posted online to obtain timely notice of such changes. Your continued use of this site after changes are posted constitutes you acceptance of this agreement as modified by the posted changes. • The service offered on this site is offered by Gasyard Development Trust and may include information provided by third parties. Whilst Gasyard Development Trust endeavours to ensure that this site is normally available 24 hours a day, Gasyard Development Trust will not be liable if for any reason the site is unavailable at any time or for any period. • Access to this site may be suspended temporarily or permanently and without notice. • Whilst Gasyard Development Trust endeavours to ensure that the information on this site is correct, no warranty, express or implied, is given as to its accuracy and Gasyard Development Trust does not accept any liability for error or omission. • Part of this site contains materials submitted to Gasyard Development Trust by third parties. Third parties are responsible for ensuring that materials submitted for inclusion on this site complies with national and relevant foreign law. Gasyard Development Trust cannot guarantee the accuracy of this material and hereby expressly disclaims any responsibility for error, omission or inaccuracy in the material, misinterpretation and any/or all loss, disappointment, negligence or damage caused by reliance on the material contained on this site or any failure or alleged failure in the delivery of the services referred to herein, or in event of the bankruptcy, liquidation or cessation of trade of any company, individual or firm referred to herein. Confirmation of the accuracy and currency in the information should be sought from the establishments concerned. Gasyard Development Trust shall not be liable for any damages (including, without limitation, damages for loss of business or loss of profits) arising in contract, tort or otherwise from the use of or inability to use this site, or any material contained in it, or from any action or decision taken as a result of using this site or any such material. • Gasyard Development Trust accepts no responsibility for the content of any site to which a hypertext link from this site exists. Such links are provided for your convenience on an "as is" basis with no warranty, express or implied, for the information provided within them. • If any of these Terms should be determined to be illegal, invalid or otherwise unenforceable, such term or Terms shall be severed and deleted from the clause concerned and the remaining Terms and conditions shall survive, remain in full force and effect and continue to be binding and enforceable. • By accessing any part of this site, you shall be deemed to have accepted these Terms in full, and the Terms herein set out comprise the entire Agreement. • These Terms shall be governed by and construed in accordance with the law of Northern Ireland and the parties submit to the jurisdiction of the courts of Northern Ireland. This, however, shall not prevent Gasyard Development Trust from pursuing a claim for breach of contract or otherwise in respect of this Agreement in any other jurisdiction. Privacy and personal data • We are committed to keeping your personal information safe. We process personal information in accordance with data protection legislation. Why do we ask for personal information from you? We ask for personal information from you when you use our website for the following reasons: • to process your order • to send you confirmation of your order by email • to contact you in the event of an emergency. What happens to your data? • Your personal data is held securely by the Museum in accordance with data protection legislation. When you book admission through our website, we will email you to confirm your order details. • We use TakePayments for collecting and processing financial data and they comply with PCI DSS regulations. • We endeavour to ensure that the third parties we use to run this area of the website collect and process your data in accordance with data protection legislation. Removing your personal data You can have your personal information removed from Museum systems at any time by emailing us at info@peacemakersmuseumderry.com. In some cases, we may not be able to remove your personal data from third party systems, such those belonging to HM Revenue & Customs. If you have any questions regarding the use of your data, please send an email to info@peacemakersmuseumderry.com. Cookies When you visit the website we may send you a cookie. A cookie is a text-only string of information that is stored by the web browser on your device so that the website can remember who you are. Cookies are used in the following ways: • to compile anonymous, aggregated statistics that allow us to understand how users use the website and to help us improve the website (we cannot identify you personally in this way) • to temporarily identify a user throughout the browser session in order to remember the selections from previous pages (these cookies do not contain any personal data and we cannot identify your personally in this way) • By using our website, you agree to provide true, accurate, current and complete information about yourself when you place an order for admission. Dealing with complaints If you are ultimately not happy with how we have handled any complaint, you may want to contact the European Commission Online Dispute Resolution platform. Nobody else has any rights under this agreement. No other person shall have any rights to enforce any of these Terms. If a court finds part of this agreement illegal, the rest will continue in force. Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect. Which laws apply to this agreement and where you may bring legal proceedings These Terms are governed by UK (NI) law and you can bring legal proceedings in respect of admission/refund in the NI courts.
